General Provisions
1 Only goods purchased through HomeChoice are covered. 2 Benefits as contained in this document will be enjoyed by all customers in relation to goods
purchased on credit. The customer will enjoy the benefits for the period during which the customer pays the purchase price of the goods in instalments in
accordance with the credit terms of HomeChoice and the Terms and Conditions of Sale. 3 Customers who buy goods in cash will enjoy the benefits for a period
of 30 days from the date of payment in full of the purchase price of the goods. 4 You may only lodge a claim if you are up-to-date with all payments due and
payable on your buying account when the event giving rise to your claim occurs, as more fully set out below. 5 The benefits will terminate when your buying
account has a zero balance. 6 If your buying account is in a state of arrears (i.e. if you fail to make payment of any amount due and payable to HomeChoice
timeously) the benefits will be suspended immediately and in relation to any and all goods which give rise to the amount(s) overdue. The benefits will remain
suspended until such time as you are once again up-to-date with all payments. 7 The benefits apply separately and divisibly in relation to each and every item
purchased from HomeChoice. 8 You may not exceed two successful claims per order (regardless of the benefits or protections relied upon). Notwithstanding any
other provision of these Terms to the contrary, HomeChoice will replace or repair a maximum of 3 items for each customer in any twelve-month period. 9 The headings used in these Terms are not to be relied upon for the purposes of interpreting the meaning of any provisions of these Terms.
Delivery Protection
1 You will not be liable for any damage to, theft or loss of the goods during the course of their transportation and delivery, by or on behalf of HomeChoice, to your
home or the Post Office, as the case may be. You enjoy this Delivery Protection benefit free of charge. 2 You bear the risk in the goods from the date and time
that you take delivery of the goods either through (1) delivery to your home or (2) collection by you, or on your behalf, from the Post Office. 3 Notwithstanding
anything to the contrary, if the goods are collected from the Post Office by you, or on your behalf, you take full responsibility (and bear the full risk) for the goods
from the time of collection until the goods are safely deposited in your home.
Product Replacement Protection
1 Any goods: 1.1 stolen from inside your home (theft must be accompanied by forcible entry); 1.2 damaged or destroyed in your home (but excluding goods
which are brittle in nature e.g. glassware, crockery and so forth), will be replaced or repaired, as appropriate, by HomeChoice, subject to these Terms. You enjoy
this Product Replacement Protection benefit free of charge. 2 Notwithstanding anything to the contrary, HomeChoice will not replace or repair goods which are
stolen, damaged or destroyed, as the case may be, as a result of: 2.1 war, riot, civil commotion or some other extraordinary event which could not have been
foreseen and which could not have been guarded against; 2.2 your negligence, or the negligence of any members of your family, or third parties who attend your
home with your permission; 2.3 your failure to make use of the goods properly, reasonably carefully or for the purpose for which they are meant; 2.4 normal wear and tear, any process of cleaning, repairing, restoring, altering, bleaching or dyeing, or moths or vermin.
The Delivery Protection
and Product Replacement Protection benefits are yours free of charge.
Whether you order on instalment or cash there is a delivery charge of 7% of your order value.
Claims Procedure
1 Upon the occurrence of any event on the basis of which you wish to lodge a claim with HomeChoice, you (or a member of your immediate family, in the event
that your state of health renders you unable to report the matter yourself) must adhere to the following procedure to lodge a claim: 1.1 Inform HomeChoice
telephonically of the event, and that you wish to lodge a claim, within 30 (thirty) days after the event; 1.2 When reporting the event to HomeChoice, provide full
details of the event, including the following information, which must be provided: 1.2.1 In the case of theft of goods: a South African Police Services (“SAPS”)
case number, under which the theft has been reported to the SAPS; a sworn affidavit, commissioned and stamped by a member of the SAPS (hereafter “SAPS
affidavit”), setting out all relevant facts relating to the theft; 1.2.2 In the case of damage or destruction of goods: a SAPS affidavit setting out all relevant facts
relating to the cause of damage or destruction of the goods. 2 Only original SAPS affidavit(s) will be accepted by HomeChoice; all other documents requested
or required by HomeChoice must be original documents or certified copies of the original. 3 HomeChoice shall have the sole discretion to request or require
from you, or any third party, any further information or documentation as it may reasonably require for the evaluation and/or processing of your claim, and you
hereby consent to HomeChoice contacting any third party including, without limitation, the relevant branch/officer of the SAPS, to verify any aspect of your claim,
supporting information or explanation. 3.1 All documentation required to process the claim must be received by HomeChoice within 60 (sixty) days of the claim
date. If documentation is not received on time, processing of the claim will be terminated. 4 HomeChoice shall have the right to refuse your claim if: 4.1 you fail
to provide all or any information requested by HomeChoice, and within the time periods specified; or 4.2 you submit any false or misleading information, either
negligently or intentionally (any rights which HomeChoice may have to take further action against you in this regard remain reserved); or 4.3 you fail to adhere to
the claims procedure specified above in any respect whatsoever; or 4.4 you fail to adhere in any respect with any reasonable request from HomeChoice. 5 Once
HomeChoice has received all requested information from you and has considered your claim, HomeChoice shall have the sole and absolute discretion to: 5.1 approve your claim; or 5.2 reject your claim; or 5.3 delay making a decision in relation to your claim while awaiting and/or requesting further information from you
and/or any other third party before the claim is finalised or a further decision taken, and any decision(s) made by HomeChoice shall be final and binding on you,
and shall not be subject to any appeal or review of any kind. HomeChoice shall further have the sole discretion whether to furnish reasons for any decision taken
in terms of these Terms. |
